Privacy Policy

This Privacy Policy explains how SendBene LLC ("Bene," "we," "us") collects, uses, and shares information when you use sendbene.com and our services. By using Bene, you agree to this Policy.
1. A quick summary
Bene coordinates in-person gestures sent by one person (the "Sender") to a guest (the "Recipient") at a venue (the "Venue"). To do that, we collect information from Senders and Venues, and we receive limited information about Recipients from the Senders who arrange moments for them. We use this information only to coordinate moments, process payment, and operate the service. We do not sell personal information.
2. Information we collect
From Senders:
- Name, email address, and phone number
- Payment information (processed by Stripe — Bene does not store full card numbers)
- The content of the request, including the chosen gesture, budget, and the personal message
About Recipients (provided by the Sender):
- Name
- The phone number on the Recipient's booking
- The Venue, reservation date, and time
- Any details the Sender shares relevant to the gesture (e.g. occasion, allergies)
From Venues:
- Business contact name, role, email, and phone
- Operational preferences and payout details
- Documents a Venue chooses to provide (e.g. tax forms)
Automatically:
- Basic usage and analytics events, and standard technical data (e.g. device/browser information). See Section 8 on cookies.
3. How we use information
- To coordinate and deliver moments between Senders and Venues
- To process payments, holds, captures, refunds, and payouts
- To send transactional communications (email and, with consent, SMS) about a moment's status
- To operate, secure, and improve the service
- To comply with legal and tax obligations, including collecting and remitting applicable sales tax where required
We do not use the personal message content or Recipient information for advertising, and we do not sell personal information.
4. About Recipient information specifically
Bene receives information about Recipients from Senders, not from the Recipients themselves. When a Sender arranges a moment, the Sender represents that they personally know the Recipient and are authorized to provide this information for the limited purpose of coordinating the gesture (see our Terms, Section 4).
We use Recipient information only to coordinate and deliver the specific moment. We do not contact Recipients directly except in the limited case of event-venue will-call pickups that are set up explicitly, and we do not add Recipients to any marketing.
If you are a Recipient and would like your information corrected or deleted, contact hello@sendbene.com and we will address your request.
5. How we share information
We share information only as needed to run the service:
- With Venues — the information necessary to fulfill a moment (e.g. the booking name, the gesture, the personal message to be read).
- With service providers who process data on our behalf, under their own terms:
- Stripe — payment processing
- Resend — transactional email
- Twilio — transactional SMS (when enabled)
- Supabase — database and storage
- Vercel — application hosting
- Google Places — venue lookup
- For legal reasons — to comply with law, enforce our Terms, or protect rights and safety.
- In a business transfer — if Bene is involved in a merger, acquisition, or sale of assets.
We do not sell personal information and do not share it with advertisers.
6. Data retention
We retain information for as long as needed to provide the service, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete or de-identify it.
7. Data security
We maintain a data-security program with reasonable administrative, technical, and physical safeguards designed to protect personal information, appropriate to our size and the sensitivity of the data. These include encryption of data in transit, access controls, and selecting service providers that are contractually obligated to protect the data we share with them. We have designated an individual responsible for our security program. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If a breach of private information affecting New York residents occurs, we will notify affected individuals and the relevant authorities as required by the New York SHIELD Act and other applicable law.
8. Cookies and analytics
We use limited cookies and similar technologies to operate the site and understand usage. You can control cookies through your browser settings. We aim for privacy-preserving defaults and do not use third-party advertising cookies.
9. Your choices and rights
- Access, correction, deletion — contact hello@sendbene.com to request access to, correction of, or deletion of your information.
- SMS — you can opt out of texts at any time by replying STOP (see our SMS terms).
- Email — transactional emails relate to your moments; we do not send marketing email by default.
Depending on where you live, you may have additional rights under applicable privacy laws, and we honor valid requests as required by law. We are a New York–based business; comprehensive state privacy laws such as the California Consumer Privacy Act and international frameworks such as the GDPR have thresholds and scope that we do not currently meet, but we will add the corresponding disclosures and rights if and when they apply to us.
10. Children
Bene is not directed to children and is intended for users 18 and older. We do not knowingly collect information from children.
11. Changes to this Policy
We may update this Policy from time to time. Material changes will be reflected by updating the effective date above.
